IndustrialSiteDesign.com is operated by Astuteo LLC ("we," "us"). By accessing or using this website, you agree to these Terms of Service. If you do not agree, please do not use the website.

Use of Website

You may use this website for lawful purposes only. You agree not to:

  • Engage in any activity that may disrupt or interfere with the proper functioning of the website.
  • Use the website for fraudulent purposes or in connection with any criminal offense.
  • Attempt to gain unauthorized access to any part of the website, user accounts, or computer systems.
  • Scrape or copy the gallery or its data in bulk without our written permission.

Accounts and Listings

Some features require an account. You're responsible for keeping your login secure and for activity under your account.

You may claim a website or agency listing only if you're authorized to represent that company. We verify claims by email and, in some cases, by review, and we may decline or remove a claim at our discretion. Owning a claimed listing lets you manage the parts of it we make editable; it doesn't transfer ownership of the gallery entry, its screenshots, or our measurements of the site. Information you add to a listing must be accurate and must not be misleading.

Intellectual Property

All content on this website, including text, images, graphics, logos, data, and other materials, is owned by us or our licensors and is protected by intellectual property laws. Screenshots and descriptions of third-party websites are shown for reference and commentary; those websites and their marks belong to their owners. You may not use, reproduce, or distribute our content without written permission.

User-Generated Content

If you submit content to the website (for example, listing details, logos, suggested changes, or articles), you grant us a non-exclusive, royalty-free license to use, modify, and display that content in connection with the website. You're responsible for making sure your content doesn't violate any laws or infringe anyone's rights.

Purchases and Payments

Payments are processed by Stripe; we don't receive or store your full card details. You agree to provide accurate billing information. Paid placements are also governed by the Paid Placements section below.

Paid Services

We offer paid products on IndustrialSiteDesign.com, such as placements that feature your company on our pages ("Paid Services"). Each Paid Service is described where you buy it, including its price, billing period, eligibility requirements, and what it includes. Those details, together with these terms, govern your purchase.

What you're buying. A Paid Service gives you what its description says for the term you've paid for. Where several companies share a placement, we may rotate their order. We may change the design of our pages or how a placement is presented, but your Paid Service stays in effect for the term you've paid for. We don't guarantee any amount of traffic, any number of leads, or a particular position. Paid placements are identified as partner or sponsored content where they appear.

Eligibility and review. Some Paid Services require a claimed listing or other criteria, which are stated when you apply. We may review applications and may decline any application. Where review applies, you're only charged after we approve it. An approval may hold your spot for a limited time; if payment isn't completed in that time, it may go to someone else.

Billing and renewal. Recurring Paid Services are billed in advance for each billing period and renew automatically until you cancel. We'll send a reminder before each annual renewal. We may change the price for future billing periods with at least 30 days' notice before your renewal date; a price change never applies to a period you've already paid for.

Cancelling. You can turn off renewal at any time from your account. Your Paid Service stays active until the end of the period you've paid for. You can withdraw an application at any time before you pay. Releasing a listing turns off renewal for Paid Services attached to it but doesn't end the current period.

Refunds. Payments for a new Paid Service aren't refundable once the billing period has started. If you didn't mean to renew, contact us within 14 days of a renewal charge and we'll refund it in full and end the Paid Service. If we end a Paid Service early for any reason other than a misleading listing or a breach of these terms, or remove the page or feature it appears on, we'll refund the unused portion of the period. If a renewal payment fails, the Paid Service ends when the paid period ends.

Removal. If you no longer meet a Paid Service's eligibility requirements, including after we change them, we may end it and refund the unused portion of the period. If your listing is misleading or you violate these terms, we may end the Paid Service without a refund. Either way, we'll tell you the reason.

Disclaimers

The content on this website is provided "as is" without warranties of any kind, either express or implied. Gallery data, measurements, and classifications are gathered automatically or by our editors and may be incomplete or out of date. We don't guarantee that the website will be error-free, uninterrupted, or secure, and we're not responsible for third-party websites or services linked from it.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or inability to use it, even if we have been advised of the possibility of such damages. Our total liability for any claim related to a paid placement is limited to the amount you paid for that placement in the 12 months before the claim.

Changes to Terms

We may update these Terms of Service from time to time. Changes take effect when posted, except that changes to the Paid Placements section take effect for an existing placement at its next renewal, and we'll notify active placement holders by email [at least 30 days] before that renewal. The "Last updated" date above shows when these terms last changed.

Termination

We may suspend or terminate your access to the website or your account if we believe you have violated these Terms of Service or engaged in unlawful activity.

Governing Law

These terms are governed by the laws of the United States and the State of Wisconsin, without regard to its conflict of law principles. Any disputes arising under or in connection with these terms will be resolved exclusively in the state or federal courts located in Wisconsin.
